The amount of space you require will vary depending on the nature of your business and the efficient use of space you select. We suggest that you meet with a medical space planning specialist to help you get accurate numbers.
In addition to your net rental rate, most commercial leases are structured such that you also pay additional rent, which covers the landlord’s operating and common area maintenance costs. These costs include, but are not limited to, insurance, building and grounds maintenance, property taxes, janitorial services, utilities, etc.
In most cases tenants are personally responsible for telecommunications expenses (phone and internet), cable, electronic medical records services, premises insurance, and maintenance/repairs for equipment, furnishings, and finishes within their premises.
During a typical lease negotiation, leasing proposals are used as a tool to determine terms and conditions acceptable to both landlord and tenant. This will precede an offer to lease outlining the final position of both parties followed by the formal lease agreement. It is typically accompanied by a leasing deposit, generally equivalent to two months’ gross rent, representing first month’s rent as well as a security deposit.
The tenant and/or landlord may not be legally bound to commit to the premises until the various conditions are satisfied.
Most commercial leases allow the tenant to sublease the premise or assign their lease, with approval by the landlord. Typically, the lessor is unable to unreasonably withhold consent to a transfer request. A prudent lessor will consider the strength of the contract being offered by the incoming tenant and will decline to accept a transfer that could potentially compromise their financial position or security.
A tenant inducement is any incentive or consideration offered to the tenant to sign or renew a lease. This may include a financial contribution to build out the space (either in the form of a tenant allowance or landlord’s work), early occupancy, free rent, etc.this expense.
Tenant improvement allowances are expressed in square feet, so a T.I. allowance of $50 / sq ft for a 1,000 sq ft office would result in a payment of $50,000. T.I. allowances are larger for longer leases, as the landlord has longer to recoup this expense. The size of the allowance differs with the quality of the building project, the condition in which the space is delivered for construction (i.e., Is HVAC ductwork in place? Has the ceiling been “dropped”?)
Rentable square feet equalS the basis for your rent. Usable square feet equals the actual square footage of your office. The difference between usable and rentable square feet is a pro rata share of the building’s common area — like public hallways, the lobby, public restrooms, etc.
Gross rent is the rent calculated inclusive of all building costs, whereas net rent is rent calculated excluding building costs. Face rent is the quoted rental rate before taking into account inducements or increases, whereas effective rent is the rental rate averaged out over the term of the lease, including inducements.
Both a construction allowance and landlord’s work are types of tenant inducements provided to the tenant to make improvements made to the space. A construction allowance is an amount paid from the landlord to the tenant to cover some or all of the costs of the renovation/build-out, wherein the tenant is responsible for coordinating the work. Landlord’s work is an agreement for the landlord to pay for and coordinate the renovation/build-out of the premises according to approved plans.
